It has been fixed upstream. What exactly do you mean with "upstream"? I see this problem happening on my Quadro FX 1500M (G71) (NV40) with the nouveau-tree as of http://cgit.freedesktop.org/nouveau/linux-2.6/commit/?id=eeec3a1ecd703d3a32fe223274d2a77686030d78 ("zcat master.tar.gz | git get-tar-commit-id" yields "eeec3a1ecd703d3a32fe223274d2a77686030d78"), which seems to be the most recent nouveau-kernel.
