Given the rewrite of the HDA driver in Linux 3.9, I also find it likely that your issue will be fixed if you upgrade to a newer kernel. Indeed, I haven't seen this bug in so long I had completely forgotten about it.
It definitely was fixed by an update, sorry I never came back to close this bug.
