When playing audio on my "avr name here" it does not output any sound, when refreshrate is > 30hz and samplerate is 44.1 khz.

It works fine for 48 khz. Furthermore all passtrough formats are working. I am running xbmc on OpenELEC.
According to my AVR pioneer SC-72 or AVR pioneer vsx-1021 this is a problem with setting some registers correctly. I sadly have no clue of the internals, but this bug is a major showstopper on my intel nuc setup.
